These Terms & Conditions ("Terms") govern your use of the website https://www.oyeservices.com and the services and products offered by Oye Services ("we", "us", "our"). By accessing the Site, registering a client account, or purchasing our services, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
1. Services
Oye Services provides digital marketing services including, without limitation, social media marketing and management, content creation, website design and development, SEO, PPC advertising, logo and brand design, and related digital products (collectively, the "Services"). The specific scope, deliverables, timelines and fees for any engagement will be described in the applicable order, proposal or service plan.
2. Client Accounts
You must provide accurate, complete and current information when registering. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorised use. We may suspend or terminate accounts that violate these Terms.
3. Fees and Payment
Fees are as quoted at the time of order or as agreed in writing. Unless stated otherwise, fees are exclusive of applicable taxes (including GST), which will be charged additionally where required. Services may be suspended for overdue payments. Prices for products displayed on the Site are in Indian Rupees (INR) unless stated otherwise.
4. Client Responsibilities
You agree to: provide timely access to accounts, brand assets, and information reasonably required to deliver the Services; ensure that all materials you supply do not infringe any third-party rights; and review and approve deliverables within a reasonable time. Delays caused by the client may extend delivery timelines.
5. Intellectual Property
Upon full payment, final deliverables created specifically for you (such as approved designs and creatives) are licensed or assigned to you as agreed in the engagement. We retain ownership of our pre-existing materials, tools, templates and know-how. You retain ownership of the materials you provide to us. We may display completed work in our portfolio unless you request otherwise in writing.
6. Third-Party Platforms
The Services depend in part on third-party platforms (such as Meta/Facebook/Instagram/WhatsApp, Google and LinkedIn). We do not control those platforms and are not responsible for their availability, policy changes, account restrictions, advertising disapprovals, or changes in reach or performance caused by them. You agree to comply with the terms of use of each platform.
7. No Guarantee of Results
Digital marketing outcomes (including followers, engagement, leads, traffic, rankings and sales) depend on many factors outside our control. While we work diligently and apply industry best practices, we do not guarantee any specific result unless expressly agreed in writing.
8. Digital Products and Downloads
Digital products purchased or accessed through the client area are licensed for your own business use only. You may not resell, redistribute or claim authorship of digital products supplied by us unless expressly permitted.
9. Prohibited Use
You must not use the Site or Services to: violate any law; infringe intellectual property rights; transmit malware or harmful code; send spam; or publish unlawful, defamatory, obscene or misleading content. We may refuse or discontinue service for any unlawful or unethical request.
10. Limitation of Liability
To the maximum extent permitted by law, Oye Services shall not be liable for any indirect, incidental, special or consequential damages, or loss of profits, revenue, data or goodwill, arising from or related to the Services or the Site. Our total aggregate liability for any claim shall not exceed the amount paid by you for the Service giving rise to the claim during the three (3) months preceding the claim.
11. Indemnity
You agree to indemnify and hold harmless Oye Services, its owners and employees from any claims, damages or expenses arising out of materials you supply, your breach of these Terms, or your misuse of the Services.
12. Termination
Either party may terminate an ongoing service engagement with written notice as specified in the applicable plan (or 30 days where not specified). Fees for work already performed are non-refundable except as set out in our Refund & Cancellation Policy.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of India. The courts having jurisdiction over the location of our registered office (Bikaner) shall have exclusive jurisdiction, subject to any mandatory consumer-law rights available to you.
14. Changes to These Terms
We may revise these Terms at any time by posting the updated version on this page. Continued use of the Site after changes constitutes acceptance.
